Article 73: (Art. 19 of the Act of 1908):
The period of limitation for a suit for compensation for false imprisonment is one year and the period of limitation starts from the date when the imprisonment ends.
ADVERTISEMENTS:
Art. 73 applies to suits for compensation for false imprisonment only. False imprisonment is a total restraint of the liberty of a person without any lawful exercise. A suit for compensation for wrongful restraint does not attract the Art. 73.
The limitation starts from the date when the imprisonment ends. Where a person was wrongfully arrested and thereafter released on bail, the limitation would start from the date of such release on bail and not from the date of arrest or the date on warrant of arrest has been set aside.
