Every expression which is explained in any part of this code is used in every part of this code in conformity with the explanation.
The Rule of Interpretation in the Code (Section 6-7):
Acceptance of a satisfactory terminology is of the first importance for securing workable rules. The law must have the same meaning for all persons. All Acts contain an interpretation clause which defines and explains the leading terms used in the Act to avoid any mistake of meaning. It is necessary that a word which occurs more than once in the same Act must be given the same meaning throughout the Act.
ADVERTISEMENTS:
To say that a particular expression shall have a particular meaning everywhere is to say that it shall have no other meaning anywhere. Every expression, which is explained in any part of this Code, is used in every part of this Code in conformity with the explanation (Section 7).
The definitions and every other provision of the Code including illustration must be read subject to the exceptions provided for in the Chapter of the Code entitled “General Exceptions”. One of the exceptions recognised in the Code is that nothing is an offence which is done by a child under seven years of age—(Vide Section 82).
The definition of any offence in the Code shall be read subject to this exception, that is, while a certain set of circumstances may make out an offence as defined in the Code, it shall cease to be the offence so defined if the doer of the wrong is a child under seven years of age. Taking another instance A, a police officer without warrant, apprehends Z who has committed murder. Here A, is not guilty of the offence of wrongful confinement; for he was bound by law to apprehend Z, and, therefore, the case falls within the general exceptions which provides that nothing is an offence which is done by a person who is bound by law to do it—(Vide Section 76).
ADVERTISEMENTS:
The exceptions, though not specified in the definition of the offence in question, shall be deemed to be incorporated therein; in other words, it shall have effect as if it had been so specified.
