Making or possession of any instrument for counterfeiting a property mark:
Making or possession of any instrument etc. for counterfeiting a property mark has been made punishable under this section. It states that whoever either makes or has in his possession, any die, plate or other instrument for the purpose of counterfeiting property mark, or has in his possession a property mark for the purpose of denoting that any goods belong to a person to whom they do not belong, shall be punished with simple or rigorous imprisonment for a term extending up to three years, or with fine, or with both.

The section requires that the offender must either make or must have in his possession any die, plate or other instrument for the purpose of counterfeiting property mark. Or, he must have in his possession a property mark for the purpose of denoting that any goods are owned by a person who is not the owner of the same. Punishment of the possession shows that preparation to commit a crime has been made an offence under this section.
The offence under this section is non-cognizable, bailable and non-compoundable, and is triable by magistrate of the first class.
