Punishment for using a false property mark:
This section punishes the offence of using a false property mark defined under section 481. It says that whoever uses any false property mark shall, unless he proves that he acted without intention to defraud, be punished with simple or rigorous imprisonment for a term extending up to one year, or with fine, or with both. As is clear from the language of the section, absence of intention to defraud on the part of the accused is a good defence to him, and it is he who has to prove this defence.
