Legal Provisions of Section 462 of Indian Penal Code, 1860.
Punishment for same offence when committed by person entrusted with custody:
Dishonestly opening a receptacle containing property which has been entrusted to the offender is punished under this section. The section states that whoever, being entrusted with any closed receptacle which either contains property or which he believes to contain property, having no authority to open the same, with the intention either to cause wrongful gain, or wrongful loss, or mischief, either breaks open or unfastens that receptacle, shall be punished with simple or rigorous imprisonment for a term extending up to three years, or with fine, or with both.

As in section 461, this section also requires dishonest intention or intention to commit mischief on the part of the offender. The offender must be entrusted with a closed receptacle containing property or which the offender believes to contain property. The offender should not have any authority to open the same. He must break open or unfasten the receptacle. The punishment under this section is a little sterner than that in the preceding section because the offender misuses the trust which was imposed on him.
The offence under this section is cognizable, bailable and non-compoundable, and is triable by any magistrate.
