House-trespass in order to commit offence punishable with death:
House-trespass in order to commit an offence punishable with death has been punished under this section. The section states that whoever commits house trespass in order to the committing of any offence punishable with death, shall be punished with imprisonment for life or with rigorous imprisonment for a term not exceeding ten years, and shall also be liable to fine.

The quantun of punishment shows that the offence under this section is a very serious offence. It is important to note that there is no provision for simple imprisonment under this section. The section does not say that an offence punishable with death must also be committed in addition to the house-trespass. The expression ‘in order to’ means ‘with the purpose of under this section.
The offence under this section is cognizable, non-bailable and non-compoundable, and is triable by court of session.
