Legal Provisions of Section 433 of Indian Penal Code, 1860.
Mischief by destroying, moving or rendering less useful a light-house or sea-mark:
Mischief by destroying, moving or rendering less useful a lighthouse or sea-mark has been made punishable under this section. The section states that whoever commits mischief by either destroying or moving any light-house or other light which is used as a sea-mark, or any sea-mark or buoy or other thing placed as a guide for navigators, or by any act which renders any such light-house, sea-mark, buoy or other such thing as mentioned above less useful as a guide for navigators, shall be punished with simple or rigorous imprisonment for a term extending up to seven years, or with fine, or with both.
ADVERTISEMENTS:
The section takes a very serious view of mischief with respect to light-house or other sea-marks etc. In this way, it is an extension of section 281 of the Code which has made exhibition of false light, mark or buoy a punishable offence. The present section requires the commission of mischief by destroying or moving a light-house or other light used as a sea-mark, or any other sea-mark or buoy or other thing which has been placed as a guide for navigators, or by any act which renders any such thing as mentioned above less useful as a guide for navigators. The offence is quite serious as is apparent from the quantum of sentence prescribed by this section.
The offence under this section is cognizable, bailable and non-compoundable, and is triable by magistrate of the first class.
