Legal Provisions of Section 24 of Indian Penal Code, 1860.
Dishonestly:
ADVERTISEMENTS:
Intention to cause wrongful gain or wrongful loss to a person is the important thing under this section. It is not necessary that actual wrongful gain or wrongful loss must result. For instance, if a domestic servant while doing cleaning in the house of his master finds the master’s watch lying on the table and puts it under the carpet with the intention of taking away the same after sometime, his intention being to cause wrongful loss to the master, his act has been done dishonestly.
In practice, however, in most cases wrongful gain or wrongful loss does take place. Where a receipt has been antedated by the accused but the prosecution fails to prove that the same was done with the intention of causing wrongful gain or wrongful loss to anyone, the act cannot be said to have been done dishonestly.
