Waging war against any Asiatic Power in alliance with the Government of India:

ADVERTISEMENTS:

This section is a reiteration of the age-old principle of peaceful co­existence of different countries of the world, especially neighbouring countries. Since India all along have been following the path of good and friendly relations with all other countries, especially its neighbours, this provision has been deliberately kept in the Indian Penal Code towards achieving that object.

The section says that waging war, or attempting to wage war against the government of any Asiatic power, which is in alliance with, or which is at peace with, the Government of India, is punishable with imprisonment for life to which fine may be added, or with simple or rigorous imprisonment extending up to seven years’ to which fine may be added, or with fine.

The offence under this section is cognizable, non-bailable and non-compoundable, and is triable by court of session.
